Welcome to zoomwedding.ru (hereinafter referred to as the "Website" or "Site," or "we" or "us"). The Website is offered to you on the condition that you agree to the contained terms without modifications ("Terms"). By using our Website, you signify your agreement to all these Terms.

Our Website is owned and operated by the Zoom Wedding Team. Our Website serves as an online platform where users can apply for an online wedding. We assist them in submitting the required documents to a U.S. county where their marriage will be registered, arrange the ceremony upon request, and deliver the marriage certificate via mail if needed (collectively referred to as "Services").

By using the Site, you agree to comply with and be legally bound by the terms and conditions of these Terms of Service ("Terms"). These Terms govern your access to and use of the Site, Services, and all Collective Content, forming a legally binding agreement between you and us.

Please read these Terms and our Privacy Policy carefully, available at https://zoomwedding.ru/policy (link to Privacy Policy), which are incorporated by reference into these Terms. If you do not agree with these Terms, you are not entitled to obtain information from the Site or otherwise continue using it. Non-compliance with Site usage rules may result in civil and criminal liability.

PLEASE READ THESE TERMS OF USE CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR LEGAL RIGHTS, REMEDIES, AND OBLIGATIONS. THIS INCLUDES VARIOUS LIMITATIONS AND EXCLUSIONS, AS WELL AS A PROVISION GOVERNING JURISDICTION AND VENUE FOR DISPUTES.

DEFINITIONS AND INTERPRETATION:

  1. “Agreement” means the terms detailed herein, including all Annexes, the privacy policy, consent for processing, transmission, storage, and deletion of your personal data, other policies mentioned on the website, and will include references to this agreement as amended, supplemented, changed, or replaced from time to time.
  2. “Couple” means pairs of people or any individual who browses the Website or fills out an application form on our website to get married via video call and receive a marriage certificate from the appropriate office in Utah County, Utah, USA.
  3. “Content” means text, graphics, images, music, audio, video, information, or other materials.
  4. “User Content” refers to all Content that a user posts, uploads, publishes, submits, or transmits to make available through our website.
  5. The official language of these Terms is Russian.
  6. Headings and subheadings are provided solely for convenience and may not be used to interpret the Terms.

RIGHT TO USE THE SITE:

  1. The use of the Site is available only to those who can form legally binding contracts under applicable law. You cannot use our services if you have not reached the legal age of marriage established in the United States of America.
  2. Use of the Site is prohibited for people who have not reached the age of majority according to the laws of the Russian Federation. Individuals under 18 years old are prohibited from using and viewing the Site's content. If you are under 18, please leave the site immediately.

SERVICES:

  1. To use our services, you need to fill out an application form. The application form requires you to upload photos of yourself and your partner, as well as other personal information specified in the form. By filling out the form, you voluntarily consent to the processing, transmission, storage, and deletion of your personal data by the Website, and give the Website and its employees permission to use your personal data to apply for a marriage license on your behalf and to digitally sign the application for you. Once we receive your application, we will provide you with a marriage license that allows you to legally participate in the wedding ceremony as a couple.
  2. You need to provide identification for two witnesses over 18 years old (international documents containing Latin alphabet information) who will be present at the ceremony and participate in the video call during the ceremony. However, witnesses do not have to be physically in the same place as the couple.
  3. During the ceremony, the officer will verify the identities of the couple and the two witnesses. The ceremony is conducted by an authorized officer of Utah County, Utah, USA, using a standard script that complies with Utah state legal requirements.
  4. You will have the opportunity to exchange vows and rings if you wish to do so. The officer will ask you, the marrying couple, whether you wish to marry each other, and both of you must respond, "I do."
  5. After the ceremony, we will finalize the registration of your wedding with the county official. You will receive a certified digital copy of the marriage certificate. A paper copy will be sent to you via standard mail, with delivery times depending on your location.
  6. The wedding ceremony must be held within 30 days of the issuance of the marriage license. If we cannot hold the ceremony within 30 days, you will need to apply for a new marriage license, and the ceremony must be conducted within 30 days of the issuance of the new license.
  7. We cannot guarantee the delivery date of the paper copy of the marriage certificate. However, we will send the certificate within 15 days of its receipt. The certificate should reach you within the delivery time of the postal service or transportation company.
  8. The official language of the ceremony is English. It is the user's responsibility to find a translator for other languages if the couple or witnesses do not have sufficient English proficiency and require simultaneous translation.
  9. All documents provided by the couple and witnesses for identification must contain information in the Latin alphabet (passport, driver's license, etc.) and be valid at the time of the ceremony.

PAYMENT:

  1. You need to pay a fee using a bank card or another payment method.
  2. All fees are listed in Russian rubles.
  3. Our website uses third-party payment service providers to receive payments from users. We are not responsible for delays or erroneous transactions or for order cancellations due to payment issues.
  4. We make every effort to work with third-party payment providers but do not control their systems, processes, technologies, or workflows, so we cannot be held responsible for any payment provider errors.
  5. Our website reserves the right to refuse to process transactions for users with a history of questionable payments, including but not limited to violations of agreements with us, breaches of any laws, non-payment of fees imposed by the issuing bank, or violations of any policies.
  6. Users acknowledge that we are not liable for any damages, losses, claims, etc., arising from the non-processing or delay in processing a transaction that is beyond our control.
  7. We reserve the right to initiate legal proceedings against those involved in fraudulent website use or other unlawful activities that violate these terms.
  8. As the seller, we are not responsible for any damages directly or indirectly resulting from a denial of authorization for any transaction from the cardholder's account due to exceeding pre-set limits mutually agreed upon with our acquiring bank.

REFUND

  1. If you wish to receive a refund after the issuance of the wedding license and choose not to proceed with the ceremony, you must write to us at [email protected]. In this case, the refund will be partial. The fee will be fully refunded if the client requests a refund before applying for the wedding license.
  2. NO REFUNDS WILL BE GIVEN AFTER THE WEDDING CEREMONY IS COMPLETED OR THE WEDDING CEREMONY IS BOOKED.

YOU AGREE AND CONFIRM:

  1. That you will use the services provided by our website, its affiliates, and contracted companies only for lawful purposes and in accordance with all applicable laws and regulations when using the site and conducting transactions on it.
  2. You will provide accurate and truthful information whenever asked. We reserve the right to confirm and verify the information and other details provided by you at any time. If verification reveals that your details are false (partially or completely), we have the right to reject your registration and prohibit you from using our website and affiliated websites' services without prior notice.
  3. That you access the services available on this site and conduct transactions at your own risk, carefully considering and reviewing your actions and information before making any transactions through this site.
  4. You agree that we are responsible only for registering the marriage in the United States. If you cannot register/legalize the marriage in your country, we are not responsible for that.

MODIFICATION OF TERMS OF SERVICE:

  1. We can modify the Terms of Service at any time without prior notice. You can access the latest version of the User Agreement anytime on our website. You should regularly review the Terms of Service on our website. If you find the amended terms unacceptable, you should discontinue using the service. However, if you continue using the service, it is considered that you have agreed to accept and abide by the amended Terms of Service of this site.

COPYRIGHTS AND TRADEMARKS:

  1. Our website explicitly reserves all intellectual property rights to all text, programs, products, processes, technology, content, logos, service marks, trademarks, copyrights, and other materials appearing on this site. Access to this site does not grant, nor should it be considered as granting, any license to any zoomwedding.ru or third-party intellectual property rights. All rights, including copyrights to this website, belong to us or third-party providers or are licensed to them. Any use of this website or its content, including copying or storing it in whole or in part, except for personal non-commercial use, is prohibited without the permission of our website. You may not modify, distribute, or repost anything on this website for any purpose.

INDEMNIFICATION CLAUSE:

You agree to defend, indemnify, and hold harmless our Company/website, its employees, directors, officers, agents, and their successors and assigns from any claims, liabilities, losses, damages, costs, and expenses, including attorneys' fees, caused by or arising out of claims based on your actions or inactions that may lead to any loss or liability for our website or any third party, including but not limited to the breach of any warranties, representations, or obligations or failure to fulfill any of your obligations under this User Agreement or arising from your violation of any applicable laws, regulations, including but not limited to intellectual property rights, statutory fee and tax payment, defamation claims, privacy or publicity rights violations, loss of services to other subscribers, and infringement of intellectual property or other rights. This clause remains in force after the expiration or termination of this User Agreement.

DISCLAIMER OF LIABILITY AND LIMITATION OF LIABILITY:

  1. The website is provided without any warranties or guarantees and in an "as-is" state. You should bear the risks associated with using the website.
  2. The website provides content from other internet sites or resources, and although our website tries to ensure the accuracy, reliability, and high quality of the materials posted on it, it does not assume liability if this turns out not to be the case. We are not responsible for any errors or omissions, nor for the results obtained from using such information, nor for any technical problems that may arise on the website.     4. Failures, bugs, errors, or inaccuracies of any kind on our Website, Services, and tools, or in information and images obtained from them;
    5. Content, actions, or inactions of third parties, including items listed using our Website, services, or tools, or removal of allegedly counterfeit items;
    6. Suspension or other actions taken concerning your account;

GOVERNING LAW AND JURISDICTION:

  1. This User Agreement shall be interpreted according to the applicable laws of the Russian Federation, regardless of your physical location.
  2. The courts in Moscow, Russia, have exclusive jurisdiction over any proceedings arising out of this Agreement.

  1. All personal information and user content provided or displayed on the Site and Services is governed by our Privacy Policy.

NOTICES:

  1. By using the Site and Services, you agree that communication with us will primarily be electronic. We will contact you via email or provide information by posting notices on the Site and Services.
  2. You acknowledge that all contracts, notices, information, and other communications we may provide electronically meet any legal requirements that such documents be in writing.
  3. Notice will be deemed received and properly served immediately after posting on the Site and Services, 24 hours after sending an email, or three days after the date of posting any letter.

COMPLIANCE WITH LEGAL NORMS:

  1. In addition to this Agreement, you must familiarize yourself with and comply with Policies, internal laws (including common law), the laws of the state of Utah, USA, international laws, statutes, ordinances, and regulations related to your use of our services. Despite the successful completion of the transaction, you must ensure strict compliance with any formalities, the non-compliance of which will render the transaction invalid or illegal.
  2. It is your responsibility, not ours, to ensure that the services and any other actions taken on the website are lawful. You must ensure that they comply with all applicable laws of the United States of America and all other countries.
  3. You must comply with the laws of the USA, the state of Utah, and federal laws.
  4. You agree not to use the Site's services for the purpose of:
    1. uploading content that is illegal, violates any third-party rights; promotes violence, cruelty, hatred, and/or discrimination based on race, nationality, gender, religion, social status, sexual orientation, and other characteristics; contains false information and/or insults directed at specific individuals, organizations, authorities;
    2. inciting unlawful actions, as well as assisting individuals whose actions are aimed at violating restrictions and prohibitions in force in the territory of the Russian Federation;
    3. violating the rights of minors and/or causing them harm in any form, including by providing them with information contained on this site and harmful to minors in accordance with Federal Law No. 436 "On Protection of Children from Information Harmful to Their Health and Development".
    4. infringing the rights of minorities;
    5. impersonating another person or representative of an organization and/or community without sufficient authority to do so, including Site staff;
    6. misleading regarding the Site's services; improper comparison of services, as well as creating a negative attitude towards individuals who do not use certain services, or condemning such individuals;
    7. uploading content that you do not have the right to make available under Russian law or pursuant to any contractual relationships;
    8. uploading content that affects and/or contains any patent, trademark, trade secret, trade name, copyright and related rights, as well as other intellectual property rights owned or lawfully used by third parties;
    9. uploading unsolicited advertising information and/or spam;
    10. collecting and processing personal data, information about the private life of any individuals;
    11. disrupting the normal operation of the Site;
    12. violating Russian or international legal norms.
    13. You agree not to use on the Site obscene language, indecent and offensive images, comparisons and expressions, including in relation to gender, race, orientation, nationality, profession, social category, age, language of a person and citizen, as well as in relation to organizations, authorities, official state symbols (flags, emblems, anthems), religious symbols, objects of cultural heritage (historical and cultural monuments).
    14. You acknowledge and agree that the Site has the right (but not the obligation) at its discretion to refuse to post and/or delete any content available through the Site's services.

FORCE MAJEURE:

  1. We shall not be liable to you in respect of anything that, if not for this provision, would or might constitute a breach of these Terms, where such failure to perform, breach or delay was due to any cause beyond our reasonable control, including, without limitation, acts of God; natural disasters; sabotage; accident; riot, insurrection, revolution; shortage of supplies, equipment, and materials; strikes and lockouts; civil disturbances; computer hacking; or malicious damage; Changes to the Terms are made by the county of Utah/state of Utah which registers marriage.

FULL AGREEMENT:

  1. These Terms, together, constitute the entire agreement and understanding between you and us and supersede any and all prior agreements or understandings (whether written, oral, or implied) relating to the subject matter herein. Any statements, inducements, promises, undertakings, or conditions not expressly set forth in these Terms shall be of no force or effect.
